SUPREME COURT INSULTS TEXAS, WHILE RULING FOR YSLETA DEL SUR PUEBLO FIRST NATION ON GAMBLING

For the second time in a week the Supreme Court has favored federally recognized First Nations sovereignty.

"Native American Tribes possess “inherent sovereign authority over their members and territories.” Oklahoma Tax Comm’n v. Citizen Band Potawatomi Tribe of Okla., 498 U. S. 505, 509 (1991)"

Now that Texas must allow for some form of gambling on all three federally recognized First Nation territories, you can bet gambling will be introduced during the next legislative session for resort areas.  This means SPI just as one example.

Beyond the Supreme Court's soft spot for First Nations, I really have no use for the Court. 

That first sentence I quote is kind of like the kettle calling the pot black when it comes to the Supreme Court.

And for the record, no matter what Texas told the Supreme Court computer bingo is played in Texas. 777 charges $25.00 for a computer where you just sit there and do nothing and it tells you if you win.  

 THE TERM MENTAL ILLNESS SHOULD BE CHANGED TO CEREBRAL NEUROLOGICAL DISEASE

The term cerebral neurological disease more accurately describes what is happening.  There is a reason the psychiatrists label and medicate with up two three medicines with the majority of patients getting no relief- their treatment plan is label and medicate.

When the first medicine does not work, they give you a second to enhance the first.  Then when the two medicines cause neurological responses they give you a third to address  the side effects.  You are getting no help, but the doctors and pharmaceutical companies are making a fortune.

Part of the problem is paper pushers write all these rules which force really bad medicine.  I would never allow a doctor who graduated a Texas Medical School to treat me.  When you have to hire doctors to be the chief of the department who graduated medical school in third-world countries and got all their advanced training in third-world countries there is a reason.  Your reputation is bad and the best want to have nothing to do with you.

I am not saying you cannot find good doctors from third world counties, you can, but our medical schools are in a sad state of affairs when that is where they have to go to find doctors to teach and head specialty departments. I will say I know an excellent Pakistani neurosurgeon in McAllen, but the VA refused to accept his recommendations.  That is how I ended up in San Antonio, and from an Anglo doctor the VA approved the same treatment plan, they rejected from the Pakistani doctor.

IN THE FIELD OF CEREBRAL NEUROLOGICAL DISEASE, MORE AND MORE MEDICAL SCHOOLS ARE DROPPING PSYCHIATRY IN FAVOR OF NEUROPSYCHIATRY 

A neuropsychiatrist will do a full endocrinological workup which will include human growth hormone if indicated.  The military has been very successful in using human growth hormone to treat active service personnel after a traumatic head injury wherein the pituitary has been injured.  The treatment happens after testing.

In psychiatry these quacks give you a serotonin uptake without first even checking  to see if you have a deficiency.  This is the cause for the high failure rate.  In fact it is a cause for some really bad side effects.  If you do not have a deficiency, then why supplement?  I can assure you unless there is a medical emergency a neuropsychiatrist will not give you any of these medicines until you are checked for deficiencies.

THE HISTORY OF WOMEN AND HISTERIA

Every woman knows what they or their friends go through during their monthly cycle.  Their estrogen levels go wild which can cause major mood swings.  It is a cerebral neurological reaction.  A neuropsychiatrist will give a woman a topical estrogen cream while they are breastfeeding to keep their estrogen at normal levels which can avoid some levels of depression.  They do not tell the woman to stop breastfeeding, they simply treat the problem.  They do not give the woman a serotonin uptake. 

THE BRAIN THROUGH THE HYPOTHALAMUS, PITUITARY, AND ADRENAL GLAND PRODUCE MANY HORMONES AND CHEMICALS WHICH REGULATE MOOD

A neuropsychiatrist will look at all these variables, before treatment.  Yes you will have to go to San Antonio or Houston to find one, but it is worth your good health.

Far  too many doctors believe patients are addicted to going to the doctor.  False.  It can be devastating to keep on going and going to just get nowhere.  You give up.  Then depression sets in.  And then a quack psychiatrist starts to pump you with drugs.

PSYCHOANALYSIS  CAN WORK IN THE HANDS OF A QUALIFIED PSYCHOANALYST

There is no magic here.  You just need someone to teach you how to identify your trigger points, and how to manage them.  Some cannot be avoided and some can never be managed.  But the power of knowing this helps.  Knowing you have a real cerebral neurological disease and not a mental illness completely changes how you think about yourself.

Yes, I have some very addictive traits.  If uncontrolled I would have sex several times a day.  But soon I will be at 18 years of abstinence.  How? a realization I do not have to give in to the urge.  My libido is crazy.  And for the record my libido was crazy even when my testosterone was under a 100, which is considered major hypogonadism. I remember going 5-6 times in one night and still wanting more.  Nothing has changed except I learned I did not have to give into it.

I do not drink, but my craving for Bourbon is non-stop all day.  I learned I do not have to give into it.

Even though I never really smoked, I crave a cigarette all day every day.  It is the brain and a very good psychoanalyst taught me it is okay to not give into the urges.  Trust me if I caved to the drinking I would be drunk all day every day, while chain smoking and having sex endlessly every day with as many people as possible.  

Now I will say since the brain surgery to drain the fluid, all of these urges have decreased significantly.  A 15 minute surgery changed everything without pushing endless drugs on me.  I would say the urges are still there but very minimal. Brain surgery not drugs.

OKAY THIS GOT LONG, BUT YOU GET THE IDEA - TOMORROW WHY MARIJUANA NEEDS TO BE LEGALIZED NOW TO  TREAT ANXIETY AND A HOST OF OTHER ISSUES

Texas does not want to fix its cerebral neurological disease problem.  It just wants to jail people, give them a lethal injection, or make them homeless.  None of this is necessary.

SSI DISABILITY

In working with good doctors we have honestly disclosed to Social Security the patient is self medicating with marijuana.  I convince the people I am helping the neuropsychiatrist needs to know so he/she does not mix in medications which would be contra indicated.

The Social Security Agency understands without marijuana to help treat a host of cerebral neurological diseases, people are going to end up being criminals, killing themselves, or worse killing others.  It is a major source of homelessness.

When I help these people we never lie.

I am working on housing rules, and Child Protective Services rules on this issue.  But Texas is stubborn and very anti-science.

I WOULD NEVER USE MARIJUANA 

First I have a host of lung disorders so I am not putting any type smoke into my lungs.  It is also one reason I still use the mask most of the time.  There are a host of things in the air which can make me sick, which have nothing to do  with COVID.  It also helps me with my allergies.

Further, I will not lie, I have smoked marijuana and inhaled.  I actually in college preferred the bong. After one really bad experience, I stopped.  But since then I have tried it a few times. At this point it does nothing for me except causes me to pitch a tent.  Embarrassing, but funny when at the beach.

My last experience was a year ago last May in California.  I tried a sour patch with marijuana.  Other than leaving me with a headache in the morning it did nothing for me.

But just because it does nothing for me, doe not mean it is not life saving  for others.

This is long and tomorrow I will address the criminal issues and how Texas is actually making things worse. 

  SUPREME COURT HAS ABOUT THREE WEEKS TO ISSUE 29 MORE OPINIONS

It is not lost on me they are expected to hold unconstitutional NY's latest gun law, as the Democrats in the House push for more money for added security for the Supreme Court and other federal judges.  You get it, the Supreme Court makes it easier for bad people to get guns, and then the taxpayer has to pay for extra security for the Supreme Court.

Now to be sure I fully support  the extra security - life matters.  But I do not support the extra security so they are not influenced by fear of guns. I support it because we have a duty to protect them.  What makes me mad is as we pay to protect them they protect the very entities which got them promoted through the system, including the NRA

THE LITTLE BIG CASE - BINGO

I expect the Texas Bingo case to be funny.  If the Ysleta First Nation wins you can expect gambling to be on the table for all resort areas in Texas come the next legislative session.  Historically, but not always, the Supreme Court seems to have a soft sport for First Nations and they tend to win.

THE ABORTION CASE

I have no idea what is going to happen.  Alleged leaked claims from clerks indicate many have hired attorneys, some who practice before the Supreme Court, to represent then during the investigation of the leak of the abortion case.  

It would not surprise me if  the Chief Justice holds the decision until the leak investigation is complete.  If a Justice or one of their clerks were involved, then that Justice no matter who they are should not be allowed to participate in the opinion.

THE  RACE TO OPINIONS

Officially they are scheduled to issue opinions today and Wednesday, but history  teachers us at the end of the Term opinions can in reality issue any day and any time of the day.

For now I wait until 9 a.m. central time to read today's opinions.

SECOND UPDATE:  The Senate has the votes for limited reform.  Well, I will say some baby steps have been taken. I really like that the background checks will include live in partners, and include access to juvenile records.  So maybe with these baby steps, if we still have another mass shooting it will make it easier to ask for more. It provides some money for schools, but nothing to keep these shooters out of malls or stores.  There are currently 20 million AR 15's in the U.S.

UPDATE:  I just watched a video of a doctor who oversaw the dead children in Ulvade.  He described how the bullets decapitated two children.  I had to stop the video to cry. 

"Speaking to the House committee, Dr. Guerrero described returning to the emergency room to horrifying sights: two children who he said had been “pulverized” and “decapitated” by bullets."

Guys if you cannot understand the Constitutional Right to Life trumps any Constitutional Right to own guns, there is nothing I can ever say to change your minds

I know I already spoke of this, but now consider it after watching this mother's very short video about the wounds her son suffered in the Buffalo mass shooting.

The Republican Party of Buffalo and the Republican voters forced their Republican House Member to withdraw from his reelection campaign for the crime of saying publicly he supports some gun  reform.

Today it is expected a bipartisan Senate Bill with really bad facial covering reforms will be announced.  Senate Majority Leader Chuck Schumer caved rather than go nuclear on the Republicans and the Democrats who refuse to vote to bypass the filibuster.

The real sad part is, because the Democrats are cowards, the Republicans will take the House and Senate and Mitch McConnel will pass Bill after Bill, bypassing the filibuster forcing Biden to veto  the Bill thereby giving the Republicans the edge of saying, "see we are getting things done, but Biden veto's everything."

The Democrats have put the welcome mat out for Trump to return to  the White House.  So who are the real traitors? 

The end is near for the Democrats and it will be well deserved.  

We either fight for a Progressive Democratic Party which  will go nuclear on the Republicans or surrender.  Biden, Chuck Schumer and Nancy Pelosi have chosen surrender.

I grew to hate the Brownsville Voice because believe it or not I was constrained in my speech.  I need to write from the true socialist perspective and not care whether the people of Brownsville want to read it.  They can wallow in their corruption while the old hags who blog for pay keep the most corrupt people in office.  Local politicos who pay old drunk hags to keep the corruption going are not worth humanity's time.

The local elected officials are just not worth my time, for blogging purposes, but they are worth my  time, when I can justify a federal complaint.  I do not need to write about it.  I just need to file the complaint and allow officials outside the area to do their job. 

I am pushing hard in Congress to demand and answer why the Cares Act investigators refuse to investigate what happened in Brownsville and Cameron county as to the Covid money and vaccines.  My time is better spent there than writing about it for my readers. I do not need to win readers or at the polls, I need to win in federal criminal court.  

I was attacked endlessly for going after our former DA Armando Villalobos.  For my work I was allowed to blog the trial live.  Nationally, only a hand  few of bloggers have been allowed to do this.  When it was done, it was the Herald called in for a possible mistrial for interacting with a juror on line.  I allowed no comments and only wrote what was said.  A few times I did explain legally what was happening.  But never did I comment on the weight of the evidence.  Every day Villalobos and the DOJ thanked me for my detailed testimony which always helped them to prepare for the next day. 

So in the same way I never let go at the federal level the indictment of Armando Villalobos, I will work daily on seeking the indictment of judges and other officials all over the state. 

I understand our schools have turned to rote memorization instead of real learning.  But we have a constitution and it still matters.

There is no issue the Senate and House can write their own rules.  But, they cannot write rules which violate the Constitution.  If the Republicans were to take control they could write a rule minorities and women must sit in the back of the chamber.  It is their rule and the Supreme Court has found they can write their own rules.

But I can guarantee you the Supreme Court would find when the rules violate the constitution, they are not enforceable.

THE FILIBUSTER AS CURRENTLY CONFIGURED IS UNCONSTITUTIONAL - BUT THE DEMOCRATS WILL NOT GO TO COURT AND CHALLENGE IT - BERNIE SANDERS IS A COMPLETE JOKE ON THIS ISSUE - ALL WORDS - NO ACTION

The Senate filibuster rule says no Bill passes without 60 votes, the Constitution says all you need is a majority.  The Constitution trumps the Senate Rule.

A filibuster  rule which allows a member to stand up and speak for 60 hours is fine.  But in the end, the Bill will still pass on a majority vote.

This is the core reason for why nothing is getting done, and the Democrats who have the power to end it, and pass gun reform, immigration reform, tax reform to make the wealthy pay their fair share, and strong laws on price gouging with major jail time, they will not even though the people will applaud them.

I AM SO TIRED WITH THE ARGUMENT ABOUT NOT TAXING THE RICH MORE

Easy question: are you opposed to people having to pay more to sit in first class instead of coach?

So why then are you opposed to people who receive the greater benefit from from the government - namely the billionaires - pay more in taxes?

You do understand Social Security is solvent.  The problem is the Republicans are paying for the billionaire and multimillionaire tax breaks with money taken from the Social Security Trust fund.

The billionaires and multi-millionaires are going to be fine in 2035 when Social Security goes broke, but you will not.  But you will keep on buying into their garbage while you and your parents go without. 

Our military and law enforcement protect these billionaires and multi-millionaires.  They have almost become  the private security service for billionaires and  corporations which do not pay taxes. We send our children to die in needless wars to protect  their assets, and then they refuse to pay their fair share for that security

It is called the benefit of the bargain - a simple capitalist term the corporatists and Republicans oppose. They are not capitalists.

DEAL WITH IT - THE DEMOCRATS CAN END THE FILIBUSTER MONDAY AND MOVE THE GOVERNMENT FORWARD, BUT THEY WILL NOT - SO DEAL WITH IT - IT IS ON THE DEMOCRATS

You know all of that fuel tax you pay at the pump, it is to maintain the interstate highway system so corporations can make billions.  There needs to be a major surcharge on the corporations, not the truck drivers, to pay the gas taxes to maintain the interstate highway system, while getting rid of the tax at the pump. There should be zero taxes at the pump for gas.

You see there are solutions, but the corporatists rule this country and the Democrats refuse to do anything to make them pay their fair share.  Just how many billions do individuals need before they have enough? 

The government can regulate pricing and the endless price gouging, but the coward Biden is giving in to his corporate friends along with the Democrats who protect the corporations.  Just keep on voting for the enemy. 

IT IS TIME FOR THE SOCIALIST VOICE BE HEARD AND THE PEOPLE EDUCATED AS TO THE  TRUTH

We want you to be left alone to live as you please within the confines of reasonable laws.  We want to protect family owned businesses.  You should always eat out locally and support your community.  This is who we really are.  I do my best to only do business with family owned businesses when I can.  The family owned business is the backbone of  this country. 

BALANCING THE ISSUES TAKES OFF NATIONALLY

Yesterday I had some time to post the piece on several like minded well read blogs.  The readership shot up,  What people do not seem to understand locally, our problems are the same as those all over the U.S.  I am just giving it the national perspective.

Biden, and especially Kamala Harris have zero chance of being reelected.  I refuse to vote for any Democrat who does not call out Biden as the inept racist he is.  I will never forget how this narrow minded racist called out a black man for not being black enough.

Biden is one of those Democrats who  thinks just because he lets black people sit at his dinner table he is not a racist.

His belief in the confessional absolves him of all sins, so he has no moral compass to guide him.  He is automatically absolved in the confessional.  This con by the Catholic Church brought slaughter to millions around the world, through war, imperialism, and conquering of First Nations around the globe.

I like Pope Francis a lot, but he knows he is impotent as the Pope because the church is no longer at one in dogma.  Such as this country it is too fractured to be fixed without radical change.  They need to end the confessional.  People need to know their sins and learn to live with them.

I enjoyed yesterday's piece, and finally getting back into the national discussions.  The response in readership was very good.

If locally Brownsville wants to think of the bigger picture, they will read what I have to say.

I am not pro Republican, but I am vehemently opposed to the Plantation Democrats.  I want a fight, and taking pictures sitting around saying we care is like a fool taking a knife to a war where the other side is aiming a nuclear weapon at you.  Biden and his minions will never take on the Republicans.  To a person they are as guilty of the 19 dead children and two teachers in Uvalde as the gunman.

Until we call them out nothing will change.

I wish I had voted for Flores, even though I know she is dangerous.  Sanchez like his brother is a coward with no regard for the people.  Until we put up true hardcore Progressives willing to go head to head with the Republicans we lose. 

By denying the Democrats any voice until they are willing to really fight and call out the Republicans for what they are, and any Democrat unwilling to vote to bypass the filibuster, I say vote Republican, because the Republicans in total control is what it is going to  take for the people to finally give a crap and end them for good. 

When in town I am willing to work with those who want to start a New Democratic Progressive Party.  We still have time to run write in candidates for November. There is a national movement.  But it takes money and those with money in Texas want nothing to do with ending the tyranny of the Plantation Democrats. So be it.  In time more progressive Democrats and true socialist like me are going to just leave Texas to those of you who prefer life in a concentration camp wherein the government dictates your every move. 

Come November if the Democrat on the statewide ticket has not called out Biden for what he is, I will pull Republican.  The Plantation Democrats are to be denied any place at the table. 

I will keep this theme going through 2024.  Not one vote to any Democrat unwilling to call out Biden for the complete and total failure and racist he is. 

 

THE INSURRECTION HEARINGS - A WASTE OF TIME OR INFORMATIVE?

Informative implies people are listening.  I watched in utter boredom, and I want Trump tried for treason. I will go so far as to say if the people of Wyoming primary Liz Cheney out of the Party, they should be renamed :The first state of insurrection and traitors."  But none of this is the point.  Was it informative?  No.  We really learned nothing which will change any person's opinion.

We as a nation are way too fractured under the current leadership, both Republican and Democrat to repair this country.  I thought Bush II was totally incompetent, but Biden gives new meaning to incompetent. 

People are hurting over the price of gas, and Biden does not invite Venezuela to a meeting of Latin American countries.  Maduro has put out an olive branch to work with American companies to get the oil moving again, but Biden says no because he wants to starve them.  He cannot tolerate any Latin American country which refuses to kowtow to the U.S.

If you think your fuel surcharge on your PUB bill was high in the bill you just got, wait until next month, it will be way over a $100.00.  This is on Biden and the Democrats. And no, I do not support the Republicans.  You can call out an incompetent Biden without supporting the Republicans.

The people of Cuba are fleeing in records numbers.  People are abandoning their homes because so many people are fleeing there is no one to buy the homes for sale.  They are flooding our border making the crisis worse. Biden now owns the border crisis.  

But Biden will do business with a leader who ordered the killing of an American journalist, but not any Latin American leader which refuses to learn their place. 

It may be time we start  thinking about trying Biden for crimes against humanity.  Any Democrat who stands with him deserves to lose. His  racist policies against Latin America will never stand in my book.  What has Cuba done to us to cause Biden to starve them to death, thereby compounding the border crisis? 

It will shock many, but if Adam Kinzinger [Republican] were able to start an independent movement for a White House  run I would donate to the campaign.  It is true we disagree on many issues, but he is very pragmatic and does not run from the truth.  Nothing is more important than restoring the Republic, and Adam is my man for that job.  I would support Liz Cheney as his VP, event though I have zero use for her father. 

There is no doubt in my mind these two would make bipartisanship the norm again and that is what the people want and this country needs.

Just weeks ago in Buffalo during a mass shooting in a predominately black community, 10 people we murdered.  Their congressman, a Republican came out for some additional gun control.  The community forced him to withdraw from his  race for reelection.  Do you think these people are listening or care?  No.  10 people murdered in a mass shooting, and the people of Buffalo forced their congressman to pull out of his reelection bid for supporting some gun control.

Newsflash, Ulvalde, Texas is predominately Republicans where 19 children were so brutally murdered only a pair of green sneakers were able to identify one child.  Nothing.  People are locked in to what they believe and 4 days of a propaganda show by the January 6th Committee will change nothing.  It is not informative.  Those who want to know the truth know the truth.

The basic core problem is  the Democrats are unwilling to come out swinging.

Chuck Schumer, as the Senate Majority leader [Democrat]  is a coward of the first degree. He needs to put the House Gun Reform bill on the floor of the Senate and call for a vote to bypass the filibuster with a clear message, everyone who votes no, especially Democrats, will have the blood on their hands of every dead child after the next mass shooting.

Every poll shows the people are tired of nothing getting done on anything.  Just do something in a very big way or resign and allow someone who is not a coward to lead.
